    By accessing or purchasing any free or paid Canine Gains, LLC course or virtual private training service made available at caninegains.com, virtual, or any other hosted location (hereinafter the “services”), you accept and agree to be bound by these Terms and Conditions (hereinafter “Terms and Conditions” or “Agreement”) including our Disclaimer and Privacy Policy posted on our website at www.caninegains.com (hereinafter the “website”) and incorporated herein by reference.

    The term “you” refers to anyone who purchases or participates in the services, uses, visits and/or views our website. Canine Gains, LLC (“company”, “I”, “we” or “us”) reserves the right to amend or modify these Terms and Conditions at any time without notice. By continuing to participate in services or use our website, you accept those amendments. It is your responsibility to periodically check the website for updates.

    Your continued use of the services and website after the posting of any changes to our Terms and Conditions constitutes your acceptance of those changes and updates. You must not access or participate in our services or purchase our course offerings if you do not wish to be bound by these Terms and Conditions.

    INTENDED AGE 

    All services and content on our website are intended for individuals over the age of 18. By participating in our services or purchasing any of the digital courses, you represent and warrant that you are over the age of 18 and can enter into these legally binding Terms and Conditions.

    PRIVACY POLICY

    COURSE DESCRIPTIONS AND PRICE

    Canine Gains, LLC offers both digital training courses and virtual private training services. Online courses include structured training lessons, drills, and progress tools, while virtual private services include evaluations, private training sessions, and coaching determined by agreement.

    Descriptions and pricing of both online and virtual private services are provided at the time of purchase. Prices are subject to change at any time prior to your booking or enrollment.

    ONLINE PAYMENTS

    We use third party service providers to process your payments. You authorize us to charge your credit or debit card, PayPal, Stripe or bank account for the purchase of the course. If we offer a payment plan then you authorize us to charge recurring payments to you as stated on the checkout page when you purchase the course. 

    All payments for virtual private services are due at the time of booking. We accept digital and virtual payments through approved providers. If you fail to attend a scheduled virtual private session without providing 24 hours’ notice, the session will be forfeited, and no refund will be issued. In the event of emergencies, please notify us as soon as possible to avoid forfeiture.

    Refunds are only available prior to the commencement of any virtual private training service. Once training has begun, no refunds will be issued. There are no refunds on completed sessions.

    MONEY BACK GUARANTEE FOR DIGITAL DIY COURSES

    We offer two types of money-back guarantees for our DIY dog training courses:

    1. 5 – Day No Questions Asked Guarantee

    We provide a full refund of the purchase price within five (5) days of purchase (the “Guarantee Period”) if you are not completely satisfied. To qualify for this refund, you must submit a written request via email to hello@caninegains.com before the expiration of the Guarantee Period and include a copy of your receipt and/or order number. After the Guarantee Period has elapsed, no refunds will be issued under this policy.

    Upon approval of your refund request, we will process the refund using the original payment method within thirty (30) days. Upon issuance of the refund, your access to the course will be immediately revoked, and you must permanently delete and destroy any course materials, including downloaded content, in your possession.

    2. Confidence Guarantee – 60 Day Full Refund Policy

    We also offer a Confidence Guarantee, which allows you to request a full refund within 60 days of purchase (the “Confidence Guarantee Period”) under the following conditions:

      • You have completed the entire course, including all chapters & lessons.

      • You have fully followed the provided Training Schedule and completed all Drill Sheets.

    •  

      • You have contacted our support team at least once for assistance with training challenges. This can be in the form of an email or via a Free 15 minute consultation call.

    •  

    To request a refund under the Confidence Guarantee, you must submit a written request via email to hello@caninegains.com  before the expiration of the Confidence Guarantee Period. Your request must include:

      • A copy of your purchase receipt.

      • Proof of course completion.

      • Evidence of at least one support request and participation in a troubleshooting session with Natasha.

      • Refund requests that fail to meet all of the above conditions will be denied.

    If approved, the refund will be issued via the original payment method within thirty (30) days. Upon refund issuance, your access to the course will be terminated immediately, and you must permanently delete and destroy all downloaded or retained course materials.

    After the expiration of the Confidence Guarantee Period, no refunds will be granted under any circumstances.

    3. Refund Requests Based on Dog Suitability

    Refunds will not be issued based on the claim that the course was “not a good fit” for your dog’s temperament, behavior, or training needs. It is the customer’s responsibility to determine whether their dog is a good candidate for structured DIY training before purchasing.

    If you are unsure whether this course is suitable for your dog, contact our team before purchasing for guidance. 

    COURSE CANCELLATION AND MODIFICATIONS

    We reserve the right to cancel or modify the course at any time without notice. We also reserve the right to cancel your order for any errors or discrepancies in our sole discretion.

    MANDATORY ARBITRATION AND GOVERNING LAW 

    You expressly waive your right to bring any legal claims, now or in the future arising out of or related to your use of the course, our website and any other products/services we offer. In the event of any dispute, claim or controversy arising out of or relating to your use of this course or our website, these terms and conditions shall be construed in accordance with the rules and regulations of the state of Colorado and the United States. 

    You agree to consent and submit to the jurisdiction of the state and federal courts located in Colorado, United States without regard to the principles of conflict of law or where the parties are located at the time a dispute arises. 

    You agree to resolve any disputes or claims first through mandatory arbitration in the state of Colorado, United States and shall bear the full cost of arbitration as permitted by law. Your good faith participation in arbitration is a condition precedent to pursuing any other legal or equitable remedies available such as litigation or any other legal procedure. You also agree that in the event a legal claim is initiated after the required arbitration, the prevailing party shall be entitled to recover reasonable attorney’s fees and other costs associated with the legal action. 

    INTELLECTUAL PROPERTY 

    All content in the course and on our website including but not limited to text, posts, logos, marks, graphics, files, materials, services, products, videos, audio, applications, computer code, designs, downloads and all other information here (collectively, the “Content”) is owned by us and is protected by copyright, trademark and other intellectual property and unfair competition laws with the exception of any content from others that we are lawfully permitted to use.  

    You are granted a limited revocable license to print or download Content from the website for your own personal, non-commercial, non-transferrable, informational and educational use only while ensuring it’s not in violation of any copyright, trademark, and intellectual property or proprietary rights.

    You agree not to copy, duplicate, steal, modify, publish, display, distribute, reproduce, store, transmit, post, create derivative works, reverse engineer, sell, rent or license any part of the Content in any way to anyone, without our prior written consent.  You agree to abide by the copyright, trademark laws and intellectual property rights and shall be solely responsible for any violations of these terms and conditions. 

    LAWFUL USE OF THE COURSE AND WEBSITE

    For any Content or information that you upload, display, post, transmit, send, email or submit to us on the website or on any of our social media sites, you warrant that you are the owner of that Content or have express permission from the owner of those intellectual property rights to use and distribute that Content to us.

      • Some dogs may require professional, in-person training beyond what this course provides.

      • You are responsible for ensuring that training methods are applied humanely and safely.

      • Training techniques should be adapted to your dog’s temperament and needs.

    By enrolling with Canine Gains, LLC, you waive all liability for any injury, damage, or harm caused by the application of the training methods provided. If you are unsure about handling your dog safely, seek the guidance of a professional trainer or behaviorist.

    AGGRESSIVE OR DANGEROUS BEHAVIOR NOTICE

    The Canine Gains DIY training course and virtual private training services are not intended to address severe behavioral issues such as aggression, reactivity, resource guarding, or biting. If your dog displays aggressive or dangerous behavior, we strongly recommend seeking in-person professional training or behavioral consultation.

    You agree that:

     

      • You will not use this training as a substitute for professional help if your dog has a history of biting, attacking, or displaying serious aggression.

      • You will not hold Canine Gains, LLC liable for any incidents related to aggression or reactivity.

      • You assume full responsibility for your dog’s behavior and the safety of those interacting with your dog.

      • If you are unsure whether this training is suitable for your dog, contact us before purchasing or participating.

    You agree that:

    You will not make any monetary or other claims against Canine Gains, LLC for the use of this Content.

    You waive any rights of approval over how the Content is used, edited, or displayed.

    Canine Gains, LLC is not obligated to use your Content and reserves the right to remove it from its platforms at its discretion.

    Both parties hereby release, discharge, and hold harmless Canine Gains, LLC, its assigns, licensees, and successors from any and all claims arising from the use of the Content, including but not limited to invasion of privacy, defamation, copyright infringement, moral rights claims, rights of publicity, or any other cause of action.

    If you do not wish for your Content to be used in this manner, do not post it within Canine Gains community groups or platforms.

    COMMUNITY ENGAGEMENT & THIRD-PARTY ADVICE

    If you choose to participate in the Canine Gains community forums, social media groups, or other online discussions, you acknowledge that any advice, recommendations, or training suggestions provided by other members are not officially endorsed by Canine Gains, LLC.

    We are not responsible for third-party advice, techniques, or methods shared within the community. Any training recommendations should be applied at your own risk. If in doubt, consult a professional before implementing advice from community discussions.

    TERMINATION

    We reserve the right in our sole discretion to refuse, remove, restrict your access, revoke and terminate your use of the course and website including any or all Content published by you or us at any time for any reason, without notice.

    VETERINARY CARE & INJURY LIABILITY

    Canine Gains, LLC is not responsible for any veterinary bills, injuries, or health issues that may arise from the application of training techniques discussed in the course.

    You acknowledge that:

     

      • Any physical activity, including training exercises, carries some risk of injury to both dog and handler.

      • You will monitor your dog’s physical and emotional well-being during training.

      • If your dog exhibits signs of stress, discomfort, or injury, you will stop training immediately and consult a veterinarian or professional trainer as needed.

      • By purchasing this course, you waive all claims against Canine Gains, LLC for any veterinary costs, injuries, or damages resulting from training.

    INDEMNIFICATION

    You agree to indemnify and hold the Company and/or its officers, employees, successors, shareholders, joint venture partners or anyone else working with us harmless from all losses, claims, damages, demands, actions, suits, proceedings or judgments, including costs, expenses and reasonable attorneys’ fees (“Liabilities”) assessed against or otherwise incurred by you arising, in whole or in part, from: (a) actions or omissions, whether done negligently or otherwise, by you, your agents, directors, officers, employees or representatives; (b) all your actions and use of the course including purchasing other products and services; (c) violation of any laws, rules, regulations or ordinances by you; or (d) violation of these terms and conditions by you or anyone related to you; e) infringement by you or any other user of your account of any intellectual property or other rights of anyone. The Company will notify you promptly of any such claims or liability and reserves the right to defend such claim, liability or damage at your expense. You shall fully cooperate and provide assistance to us if requested, without any cost, to defend any such claims. 

    ENTIRE AGREEMENT

    These Terms and Conditions along with our Privacy Policy and Disclaimer constitute the entire agreement between you and us with respect to your purchase of the course and use of our website. It supersedes all prior or contemporaneous communications, discussions, negotiations or proposals we may have had with you whether electronic, oral or written. 

    A printed version of this entire agreement including the Privacy Policy and Disclaimer and of any notice given in electronic form shall be admissible in judicial or administrative proceedings with respect to this course to the same extent and given the same effect as other business contracts and documents kept and maintained in printed form. 

    SEVERABILITY

    COUNTERPARTS

    These Terms and Conditions may be executed in two (2) or more counterparts, including by tele-copier, tele-facsimile, or by electronic means, such as by encrypted digital signature, by electronic mail transmission of a portable document format (PDF) scan of the original document or a copy thereof; and when so executed, will have the same force and effect as though all signatures appeared on a single document. Emails and copies of signatures are acceptable in lieu of originals. Prior to purchasing the course, you will click to accept these Terms and Conditions electronically and by purchasing the course, you agree to be bound by them.
